CUSTOMER AUTHORIZATION
By requesting, scheduling, or accepting services from Sunset Assistance, the customer acknowledges that they have read, understood, and agree to these Terms of Service.
The customer acknowledges and accepts the inherent risks associated with roadside services. Nothing in these Terms shall limit Sunset Assistance's responsibility for damages directly caused by proven negligence where required by applicable law.
Estimates & Additional Services
If additional repairs or towing become necessary after the initial service begins, Sunset Assistance will explain the available options and obtain customer approval before performing any additional billable work whenever practical.
MECHANICAL SERVICES
I authorize the roadside service technician to inspect, diagnose, and perform the requested mechanical service on my vehicle. I understand that roadside repairs are intended to restore the vehicle to an operable condition whenever practical and are not a substitute for comprehensive repairs performed by a licensed repair facility.
I understand that additional issues may be discovered during the inspection or repair process. Sunset Assistance will inform me of any additional concerns before performing any additional billable work whenever practical.
Roadside repairs are performed under field conditions and may not be equivalent to repairs performed in a repair shop. While every reasonable effort will be made to complete repairs safely and professionally, I understand that unforeseen circumstances or pre-existing conditions may prevent a permanent repair.
Any damage proven to be the direct result of negligence by Sunset Assistance will be addressed in accordance with applicable law. Sunset Assistance shall not be responsible for failures resulting from pre-existing mechanical defects, worn or damaged components, corrosion, prior repairs, manufacturer defects, or parts that fail during normal removal or installation due to their existing condition.
The customer understands that no guarantee can be made that the requested repair will permanently resolve the vehicle's mechanical issue, and additional repairs by a licensed repair facility may be necessary.
Lockout, Jumpstart, Fuel Delivery
In requesting this service I am aware that in the event of a Lockout the technician will be using lockout tools to perform this job. During this there is a possibility of damage to the door, door frame, weather stripping, locking mechanism, glass or air bags when using these tools and thereby release the technician and Sunset Assistance, LLC directly or indirectly of all responsibility, both civil and criminal, in a court of law. I will accept full responsibility should any damage occur.
Any damage claim pertaining to this specific service that has been deemed neglectful by a court of law or authorized arbitration center can be submitted directly to Sunset Assistance, LLC. All other damage is the full responsibility of the customer. Any claim without a ruling from a court/arbitration center stating the damage was the result of neglect will be denied.
PAYMENT TERMS
Payment is due upon completion of services unless other arrangements have been made in writing. Estimates are provided in good faith; however, additional labor, parts, taxes, or services may be required based on vehicle condition or customer requests. Failure to remit payment may result in collection efforts, additional fees where permitted by law, and any other remedies available under Colorado law.
PERSONAL PROPERTY
Sunset Assistance is not responsible for the loss, theft, or damage of personal property left inside or attached to the vehicle unless directly caused by proven negligence.
WEATHER & ENVIRONMENTAL CONDITIONS
Roadside assistance is performed in uncontrolled environments. Weather, visibility, terrain, road conditions, and traffic may delay, limit, or prevent services from being safely completed.
Sunset Assistance reserves the right to delay or discontinue service when conditions are determined to be unsafe.
APPOINTMENT & ARRIVAL TIMES
Estimated arrival times are provided in good faith but are not guaranteed. Traffic, weather, previous service calls, emergency incidents, road closures, or other unforeseen circumstances may affect response times.
WARRANTY DISCLAIMER
Except where otherwise required by law or expressly stated in writing, Sunset Assistance makes no warranties, express or implied, regarding roadside services or repairs performed. Roadside repairs are intended to restore mobility whenever practical and are not guaranteed to provide a permanent repair.
GOVERNING LAW
These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Colorado. Any legal proceedings arising from services provided by Sunset Assistance LLC shall be subject to the applicable courts located within the State of Colorado unless otherwise required by law.
LIMITATION OF LIABILITY
Except where prohibited by applicable law, Sunset Assistance LLC's total liability for any claim arising from services provided shall not exceed the amount paid for the specific service giving rise to the claim. Sunset Assistance shall not be liable for indirect, incidental, special, consequential, or punitive damages.
VEHICLE MODIFICATIONS
The customer is responsible for informing Sunset Assistance of any suspension modifications, oversized tires, lowered ride height, aftermarket body components, disabled parking brakes, locking differentials, or other modifications that may affect recovery, towing, lifting, or repairs.
WINCHING & RECOVERY 2
Recovery operations involve significant forces applied to vehicles and equipment. The customer understands there is an inherent risk of additional damage when recovering vehicles from ditches, mud, snow, sand, embankments, or other off-road conditions. Every reasonable effort will be made to minimize damage; however, recovery operations cannot guarantee damage-free extraction.
Towing and recovery
have requested service for the following job Towing or Recovery. In requesting this service I am aware that in the event of a Recovery the driver will be using tools and equipment to perform this job. During this there is a possibility of damage to the undercarriage, frame, bumpers, tires, rims, etc. When using these tools/equipment and thereby release the driver and Sunset Assistance, LLC directly or indirectly of all responsibility, both civil and criminal, in a court of law. I will accept full responsibility should any damage occur.
Any damage claim pertaining to this specific service that has been deemed neglectful by a court of law or authorized arbitration center can be submitted directly to Sunset Assistance, LLC. All other damage is the full responsibility of the customer. Any claim without a ruling from a court/arbitration center stating the damage was the result of neglect will be denied.
I authorize the driver to complete the work requested and understand the driver is not responsible for any damage to the vehicle prior to the arrival of the driver. The customer is aware that in the event of breaking or snapping of two points during the vehicle being towed, and any damages caused from snapping or breaking tow points. This will not be considered negligent on the part of the driver but rather damage caused by a pre-existing condition.
The driver will take pictures before and after loading the vehicle, as well as any pre-existing damage on the vehicle. The driver will also inform you of any and all damage pre-existing or caused before, during, and after the provided service
PARTS AND CUSTOMER-SUPPLIED COMPONENTS
If replacement parts are installed, I understand that the quality, warranty, and availability of those parts are subject to the manufacturer or supplier.
If I provide my own replacement parts, Sunset Assistance cannot guarantee their quality, compatibility, or performance and assumes no responsibility for defects or failures related to customer-supplied components.
Any manufacturer's warranty on replacement parts remains solely with the manufacturer or supplier.
AFTERMARKET ACCESSORIES & VEHICLE EQUIPMENT
I understand that certain repairs may require the temporary removal, adjustment, or handling of aftermarket accessories or vehicle equipment, including but not limited to light bars, winches, skid plates, aftermarket bumpers, suspension components, toolboxes, ladder racks, storage systems, or electrical accessories.
Customer-supplied parts that are incorrect, defective, or incompatible may result in additional labor charges if installation has begun.
Sunset Assistance will exercise reasonable care while performing these services but shall not be responsible for failures caused by improper installation, pre-existing damage, corrosion, previous modifications, concealed defects, or equipment not installed to manufacturer specifications.
FLUID SERVICES
The customer authorizes the addition, replacement, or exchange of vehicle fluids as requested.
Sunset Assistance is not responsible for failures caused by pre-existing leaks, worn seals, contaminated systems, or internal mechanical damage that becomes apparent following service.
ELECTRICAL SERVICES
Electrical diagnostics and repairs are performed using industry-standard procedures.
Because modern vehicles contain complex electronic systems, additional faults may be present that cannot be identified during a roadside service.
Sunset Assistance cannot guarantee correction of all electrical issues during a single service visit.
RIGHT TO REFUSE SERVICE
Sunset Assistance reserves the right to refuse or discontinue service at any time if the technician determines that performing the requested service would create an unsafe condition or otherwise be inappropriate.
Service may be refused or discontinued for reasons including, but not limited to:
Unsafe traffic or environmental conditions.
The vehicle presents an unreasonable safety hazard.
The requested repair exceeds the capabilities of roadside service.
The customer or occupants are threatening, abusive, or engaging in unlawful conduct.
The customer appears to be impaired by drugs or alcohol to the extent that it creates an unsafe work environment.
The vehicle contains hazardous materials or unsafe cargo.
Law enforcement or emergency personnel direct the technician to discontinue operations.
If service is refused or discontinued after work has begun, the customer remains responsible for labor, travel, and any services already performed.
PHOTOGRAPHS & DOCUMENTATION
Sunset Assistance may photograph or document the vehicle before, during, and after services for quality assurance, damage documentation, insurance purposes, training, or legal protection.
Photographs will not intentionally disclose personal information unless required by law or legal proceedings.
FORCE MAJEURE
Sunset Assistance shall not be liable for delays or inability to perform services caused by circumstances beyond its reasonable control, including but not limited to severe weather, natural disasters, road closures, civil emergencies, equipment failures, or governmental actions.
INDEPENDENT CONTRACTORS
Sunset Assistance may utilize qualified contractors or partner companies to perform requested services. All technicians are expected to perform services in accordance with Sunset Assistance's operational standards and applicable law.
BIOHAZARD / UNSAFE VEHICLES
Sunset Assistance reserves the right to refuse service on vehicles containing hazardous materials, excessive biological contamination, infestations, fire damage, or other unsafe conditions until properly remediated.
HIDDEN DAMAGE
The customer acknowledges that damage hidden by dirt, corrosion, previous repairs, collision damage, rust, or concealed mechanical failures may become visible during or after service. Sunset Assistance shall not be responsible for pre-existing conditions discovered during normal service procedures.
Tire changes and Pushbar
I authorize the roadside service technician to complete the work requested and understand the technician is not responsible for any damage to the vehicle prior to the arrival of the roadside service technician. The customer is aware that in the event of a stud breaking during the removal of a lug nut, it will not be considered negligent on the part of the technician but rather damage caused by a pre-existing condition.
The customer understands that the spare tire is designed to get the vehicle to the NEAREST tire repair facility from the location of the incident. Spare tires are only to be used at 50 mph for a distance no greater than 40 miles from date manufactured. Each use of the spare tire from date of manufacture decreases this distance by that of which it was driven previously. The customer is aware the service technician is not responsible for old or faulty spare tires as they are only designed to last 4 to 6 years and it is the customers responsibility to replace and inspect their equipment.
PUSH BAR
Sunset may have to have Vehicle on Vehicle contact to get you off of a main road or highway. I am aware that in the event of a PBO the driver will be using tools and equipment to perform this job. During this there is a possibility of damage to the undercarriage, frame, bumpers, tires, rims, etc. When using these tools/equipment and thereby release the driver and Sunset Assistance, LLC directly or indirectly of all responsibility, both civil and criminal, in a court of law. I will accept full responsibility should any damage occur.
BATTERY SERVICES
Battery testing is intended to evaluate the condition of the battery and charging system at the time of service. Battery performance may change due to temperature, vehicle condition, or electrical system faults that are not immediately detectable.
When replacing a battery, the customer understands that additional electrical issues may exist that are unrelated to the battery itself. Sunset Assistance cannot guarantee that battery replacement alone will resolve all starting or charging concerns.
Electrical systems contain numerous components that may contribute to charging or starting concerns. A battery replacement does not guarantee correction of all electrical or drivability issues.
TIRE SERVICES
The customer authorizes tire changes, tire inflation, plug repairs (where applicable), and related roadside tire services.
Tire pressure recommendations are the responsibility of the vehicle manufacturer. Tires will be inflated to a safe operating pressure unless otherwise requested by the customer.
The customer understands that temporary tire repairs are intended only to allow the vehicle to reach a proper repair facility. Sunset Assistance recommends that any repaired tire be professionally inspected as soon as possible.
Sunset Assistance is not responsible for tire failures caused by previous damage, sidewall punctures, internal structural damage, worn tires, damaged wheels, or improper tire repairs performed prior to service.
MOBILE REPAIR LIMITATIONS
The customer understands that repairs are being performed outside of a controlled shop environment.
Weather, lighting, road conditions, traffic, equipment limitations, and vehicle accessibility may affect the ability to complete repairs.
Sunset Assistance reserves the right to discontinue a repair if it is determined that continuing would create an unsafe condition for the technician, the customer, or the public.
CUSTOMER RESPONSIBILITIES
The customer agrees to provide accurate information regarding the vehicle, its location, and the requested service.
The customer is responsible for:
Providing access to the vehicle.
Securing pets and personal belongings.
Removing valuables from the vehicle before towing when possible.
Informing the technician of any known mechanical issues or modifications that may affect service.
Ensuring the vehicle is legally accessible for service.
DIAGNOSTIC SERVICES
I authorize Sunset Assistance to perform diagnostic testing using professional diagnostic equipment and inspection procedures.
Diagnostic services are intended to identify faults or probable causes based on the information available at the time of service. Because vehicle systems are complex, additional testing or repairs may be required before a complete diagnosis can be confirmed.
Diagnostic fees cover the technician's time, expertise, and testing procedures and are non-refundable regardless of whether repairs are performed.
ABANDONED VEHICLES
Vehicles left unattended or abandoned following completion of services may be subject to storage charges, towing, or other actions permitted under applicable law.
CUSTOMER ABSENCE
If the customer authorizes services without remaining present, the customer accepts responsibility for all work requested and acknowledges that services will be completed based upon the information provided at the time of dispatch.
RELEASE OF PARKING BRAKES / TRANSMISSIONS
The customer understands that certain recovery or towing operations may require placing the transmission in Neutral, releasing the parking brake, or otherwise preparing the vehicle for transport. Sunset Assistance is not responsible for damage resulting from pre-existing drivetrain or brake defects discovered during these procedures.
ENTIRE AGREEMENT
These Terms of Service constitute the complete agreement between the customer and Sunset Assistance LLC regarding the requested services. If any provision is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
All services
I have had the opportunity to inspect my vehicle and have found it to be in good working order and that no damage as a result of the service provided has occurred to the vehicle including doors, door frame, paint, glass, window tint, rims, lug nuts / studs, body or underbody of the vehicle. I also acknowledge that all equipment such as jacks, lug wrenches, lug nut keys and special tools belonging to me or the vehicle have been returned in good working order.
Sunset Assistance performs roadside repairs designed to safely assist motorists in returning to the road whenever practical. Roadside services are not intended to replace comprehensive inspection and repair by a licensed automotive repair facility.
Failure to pay will result in additional fees and possible vehicle impounding under pretences of failure to pay under 42-13-106, C.R.S. 18-4-401, C.R.S. 18-1.3-702, C.R.S
